Eviction-Step Two, the Lawsuit

Fill out the Summons and Complaint form and the Complaint form, attach the lease if you have one and attach a copy of the Notice To Quit or Terminate Tenancy and original signature on the Proof of Service to the Complaint. 

 

Personally serve the Summons and Complaint with copies of any attachments on the renter(s). if husband and wife make sure they each get a copy, and also send a copy to each renter by mail.  When you mail it go to the post office and have them stamp a "Proof of Mailing" for you so that you can staple it to your Proof of Service that you file with the court. 

 

There is one type of Summons, use it for any type of Landlord/Tenant case.

 

Summons

 

There are 3 different types of "Complaints";

the one you use depends on the type of "7 Day Notice" you served on your tenants (or trespassers, or holdovers). 

 

Complaint for Non-Payment of Rent:  Okay, 7 days have passed since you gave the tenants the 7 day notice for non-payment of rent and still no money from the tenants. You can now file this Complaint with the District Court.

Complaint for Health concerns or because of Injury to the Premises:  So, 7 days have passed since you gave the tenants the 7 day notice to address your Health concerns about your rented property, or to address you concerns for injury to your property.  You can now file this Complaint with the District Court.

Complaint to Terminate Tenancy:  The lease has expired, or there is no lease for any reason including the fact that the tenants are 'holdovers' or 'trespassers' and 7 days have passed since you gave the tenants the Termination of Tenancy Notice.  You can now file this Complaint with the District Court.
